What is copyright?
Copyright is a form of protection provided for original works of authorship, including literary, dramatic, musical, graphic and audiovisual creations.
"Copyright" literally means the right to copy, but has come to mean that body of exclusive rights granted by law to copyright owners for protection of their work.
What is copyright infringement?
Copyright infringement occurs when a copyrighted work is reproduced, distributed, performed, publicly displayed, or made into a derivative work without the permission of the copyright owner.
Posting copyright-infringing content can lead to the termination of your account, and possibly monetary damages if a copyright owner decides to take legal action (this is serious—you can get sued!). Below are some guidelines to help you determine whether your submission is eligible or whether it infringes someone else's copyright.
What are copyright concerns for song composers/submitters?
PONG BEATS welcome composers to submit compositions which involve a backing track in the form of mp3 or m4a and a melody format in PONG BEATS midi template. It is important that composers/submitters are aware of their copyright grounds when they wish to write a song that is a 'derivative' product. However, PONG BEATS makes the relationship in such a way that, in an analogy, composers are not distributing a completed song but merely sharing a music guideline through a software instrument which in this case the PONG BEATS App. PONG BEATS only act as the instrument, ( in the form of a game ) that creates end players the opportunity to listen and play songs written by others. The composer therefore makes no commercial purposes/benefits. The relationship between the composer and the end players is a one-to-many private relationship. PONG BEATS therefore hold no responsibilities for the content that are submitted and hence however they are used when downloaded by the end users.
What are copyright concerns for end players?
All song notes submitted through PONG BEATS are to be played correctly in order to form (audibly resemble) the song that it represents. Hence, end users are playing in 'private' in most cases when using the app on their Apple devices which compiles with the copyright restrictions for covers. Secondly, the songs in PONG BEATS can not be played automatically and therefore, can not resemble what the song is without a human player to play it correctly much like playing an instrument with a instruction score. It is up to the end user to seek approval from the original composer/creator to play the song through their hand held device in "public".
What does PONG BEATS do?
As a general matter, we at PONG BEATS respect the rights of artists and creators, and hope you will work with us to keep our community a creative, legal and positive experience for everyone, including artists and creators.
